These Terms of Use govern your use of tophospicecare.com (the “Site”), operated by Top Hospice Care (“we,” “us”). By using the Site, you agree to these terms. If you do not agree, please do not use the Site.

1. Information only, no professional advice

The content on the Site, including the Hospice Guide, listings, ratings and data, is provided for general educational purposes. It is not a substitute for advice from a physician, nurse, attorney, financial advisor or other qualified professional. No doctor-patient or other professional relationship is created by your use of the Site. Always talk with a qualified professional about decisions that affect health, care or money. 2. Sources and accuracy

Our content is based on research from official and published sources, such as the Centers for Medicare & Medicaid Services (CMS), Medicare.gov and state agencies, and on information that hospices submit. These sources can be incomplete, out of date or wrong, and rules change. We try to keep the Site accurate, but we do not promise that any information is complete, current or error-free, and we have no duty to update it. Always confirm important details directly with the hospice, Medicare or the relevant agency.

3. Hospice listings

A listing on the Site is not a recommendation, endorsement or referral. A “Verified” badge means only that we checked certain official records on the date shown, as described in our verification standards. It is not a guarantee of quality, safety, licensing status after that date, or outcomes. “Featured” and “Sponsored” content is paid advertising and is labeled. Hospices are independent businesses. We are not responsible for their services, statements, pricing, conduct or care, and any dealings you have with a hospice are solely between you and that hospice.

4. Your use of the Site

You agree not to:

• Use the Site for anything unlawful, false or misleading
• Copy, scrape or bulk download listings or content, or use them to build a competing product, without our written permission
• Interfere with the Site’s security or operation, or try to access accounts or systems that are not yours
• Impersonate a hospice or person, or claim a listing you are not authorized to manage
• Post content that infringes another person’s rights or that is defamatory, harassing or contains patient health information

5. Accounts

If you create an account, you are responsible for keeping your login secure and for activity under your account. Tell us right away if you think your account has been misused. We may suspend or close accounts that break these terms.

6. Paid plans

Hospices that claim a listing or buy a plan, sponsored article or other service also agree to our listing terms, which are part of these terms.

7. Our content and your content

The Site’s design, text, graphics, guides and compilation of data belong to us or our licensors and are protected by copyright and other laws. You may view and print pages for personal, non-commercial use. Public government data remains public. When you submit content to the Site, such as a profile description, photo or correction, you confirm you have the right to do so and give us a non-exclusive, worldwide, royalty-free license to host, display, edit for format and distribute it on the Site and in its promotion.

8. Links to other sites

The Site links to websites we do not control. We are not responsible for their content, accuracy, privacy practices or availability.

9. Disclaimer of warranties

THE SITE AND ALL CONTENT, LISTINGS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE OR FREE OF ERRORS OR HARMFUL COMPONENTS.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE OR GOODWILL, ARISING FROM OR RELATED TO THE SITE, ITS CONTENT, ANY LISTING, OR ANY HOSPICE OR OTHER THIRD PARTY, EVEN IF WE WERE TOLD SUCH DAMAGES WERE POSSIBLE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR (B) ONE HUNDRED U.S. DOLLARS ($100). Some laws do not allow certain limits, so some of these may not apply to you.

11. Indemnity

You agree to defend, indemnify and hold us harmless from claims, losses and expenses, including reasonable attorneys’ fees, arising from your misuse of the Site, content you submit, or your breach of these terms or of law.

12. Changes and termination

We may change, suspend or discontinue any part of the Site at any time. We may update these terms by posting a new version with a new “Last updated” date. Continuing to use the Site after a change means you accept the updated terms.

13. Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.

14. General

If any part of these terms is found unenforceable, the rest stays in effect. Our failure to enforce a term is not a waiver. These terms, together with our privacy policy and, for hospices, our listing terms, are the entire agreement between you and us about the Site.
